Carnival Passengers Ask Judge To Keep Cruise Suit Afloat

Law360, New York (May 3, 2013, 5:38 PM EDT) -- A proposed class of passengers who took an infamously catastrophic Carnival Corp. cruise in February urged a Florida federal judge Thursday to let their lawsuit over the incident continue, saying class action waivers in the company's tickets are invalid.

Lawyers for plaintiffs also argued that Carnival's attempt to dismiss the case was premature, saying the company's ticket contract defenses could only be applied after discovery had been undertaken.
