Sears Says High Court’s Comcast Ruling Dooms Washer Class

Law360, New York (May 14, 2013, 5:46 PM EDT) -- Sears Roebuck & Co. told the U.S. Supreme Court on Monday that its recent Comcast Corp. v. Behrend decision should wipe out a Seventh Circuit ruling in support of class certification in a washing machine defect action.

Sears filed a certiorari petition with the high court on Feb. 27, arguing the Seventh Circuit was wrong to back the certification of a class of washer owners for reasons of efficiency.
