High Court To Review Preemption Of Frequent Flier Suits

Law360, Los Angeles (May 20, 2013, 3:54 PM EDT) -- The U.S. Supreme Court said on Monday that it would decide whether or not the Airline Deregulation Act preempts breach of contract suits against airlines, granting writ to a proposed class action brought by consumers against a Delta Airlines Inc. subsidiary.

The high court agreed to decide whether the Ninth Circuit erred when it found that the ADA doesn’t preempt such suits, saying the law wasn’t intended to block breach of contract suits based on the doctrine of good faith and fair dealing.
