High Court Snubs Nucor's Class Cert. Appeal In Bias Suit

By Dan Prochilo (May 20, 2013, 4:35 PM EDT) -- The U.S. Supreme Court refused Monday to hear an appeal from Nucor Corp. of a ruling awarding class certification to black workers for the company's South Carolina factory, who sued alleging they worked in a hostile environment and faced racial discrimination.

Nucor, the nation's largest steel producer, said the Fourth Circuit's August 2009 decision granting certification to a proposed class of more than 100 Nucor employees pre-dated and was invalidated by the Supreme Court's 2011 Wal-Mart Stores Inc. v. Dukes decision.
