Motorola To Get Jury Trial In Microsoft FRAND Case

Law360, New York (May 21, 2013, 4:26 PM EDT) -- A Washington federal judge ruled Monday that Google Inc.'s Motorola Mobility LLC will face a jury trial — not a bench trial — when it defends claims this summer that it breached its obligation to license standards-essential patents to Microsoft Corp. at reasonable rates.

U.S. District Judge James Robart said that not only had Motorola not waived its right to trial by jury, as Microsoft had claimed, but that software giant itself had actually requested one much earlier in the complex, consolidated litigation.
