NJ Court Orders DEP To Revisit Brownfield Cleanup Loan

Law360, New York (May 22, 2013, 8:21 PM EDT) -- A New Jersey appellate court on Wednesday ordered the state’s environmental regulator to reconsider a grant application for contamination cleanup costs from a property owner that says the regulator capriciously denied its application due to a change in its corporate structure.

A two-judge panel on the Superior Court of New Jersey, Appellate Division ordered New Jersey’s Department of Environmental Protection to revisit an application from Cliflake Associates LLC, which asked to be deemed an “innocent party,” which would avail grant funds to remediate a contaminated property...
