Delta Merger Would Face Antitrust Hurdles

Law360, New York (January 16, 2008, 12:00 AM EST) -- As Delta Air Lines Inc. ponders which would make the best mate, Northwest Airlines or United Airlines, experts wonder whether either combination would pass muster with U.S. regulators.

With Delta as the country's third-largest airline, Northwest the fifth, and United the second, a marriage between Delta and either carrier could further hinder the ability of other airline companies to compete. Approval may come only on the condition that the merged airline give up some of its gates to allow for more competition, experts say.
