9th Circ. Upsets Union's Win Against Idaho Right-To-Work Law

Law360, New York (May 23, 2013, 4:40 PM EDT) -- The Ninth Circuit on Wednesday overturned a labor union's successful challenge to Idaho's recent expansion of its right-to-work law, ruling the district court needed to determine whether the state's attorney general had authority to enforce the statutes before the case could proceed.

A federal judge ruled in 2011 that Idaho's Open Access to Work Act and Fairness in Contracting Act were preempted by the National Labor Relations Act, but the appeals court said changes to the law since then had put the state AG's enforcement power...
