Law Firm's 401(k) Plan Suit To Continue V. Hancock

Law360, New York (January 17, 2008, 12:00 AM EST) -- A federal judge has allowed breach of fiduciary duty claims brought by the 401(k) plan of law firm Bowman, Heintz, Boscia & Vician PC to continue against its plan administrators, denying motions by John Hancock Life Insurance Co. and Bisys Group Inc.

On Tuesday, Judge Philip P. Simon of the U.S. District Court for the Northern District of Indiana dismissed one claim brought by the Bowman Heintz plan against its administrators.

But he allowed the allegations that John Hancock wrongfully assessed an excessive “transfer adjustment fee”...
