Davis & Gilbert Dodges $8M Malpractice Suit Over Movie IP

Law360, New York (May 28, 2013, 2:17 PM EDT) -- A New York state judge has thrown out an $8 million legal malpractice suit claiming Davis & Gilbert LLP failed to secure copyright permissions when a film called "Dance Cuba" was sold to plaintiff production company Candela Entertainment Inc., according to a decision posted Friday. 

Judge Eileen Bransten also threw out duplicative negligence, breach of fiduciary duty and breach of contract claims against the New York-based law firm but allowed Candela and individual plaintiff Cynthia Newport the opportunity to redraw their complaint.
