Morgan Stanley Workers Fight Dismissal Bid In Wages MDL

Law360, New York (May 29, 2013, 5:30 PM EDT) -- The New Jersey federal judge overseeing multidistrict overtime litigation against Morgan Stanley Smith Barney LLC should leave claims that the company took illegal deductions from wages intact, the plaintiffs said Tuesday, arguing that their allegations were sufficient to survive the company's dismissal bid.

The plaintiffs, who are looking to represent current and former financial advisers, have adequately alleged that the commissions they received from MSSB were wages within the meaning of New Jersey, New York and Connecticut labor law and that the company made improper deductions,...
