Winning Bid For Refco IP Puts Software Maker In A Jam

Law360 (November 10, 2005, 12:00 AM EST) -- Two contentious lawsuits over Trading Technologies’ heavily asserted patents for futures trading software face an uncertain outcome after bankrupt defendant Refco LLC was purchased at auction Wednesday by another defendant, Man Group PLC.

A stipulation in Refco’s bankruptcy has raised the ire of Trading Technologies by guaranteeing the winning bidder that the New York-based commodities broker’s allegedly infringing software will be cleared of liability as part of the deal.

That raises the question of whether or not either suit will survive if the transaction is approved...
