Schering Says FCA Integrilin Kickbacks Suit Doesn't Stick

Law360, New York (May 31, 2013, 1:57 PM EDT) -- Schering-Plough Corp. and Millennium Pharmaceuticals Inc. asked a California federal judge Thursday to dismiss a whistleblower's False Claims Act suit accusing them of misbranding heart medication Integrilin and paying kickbacks to doctors, saying the plaintiff had failed show any actual false claims.

According to Schering, relator Frank Solis had failed to specifically show how their alleged off-label marketing scheme for Integrilin had caused hospitals to present false claims for payment to Medicaid or Medicare, instead wrongly conflating all off-label uses for the drug as completely ineligible...
