Justices Pass On 2nd Circ. Fosamax Jaw-Injury Ruling

Law360, New York (June 3, 2013, 3:03 PM EDT) -- The U.S. Supreme Court declined Monday to review the Second Circuit's ruling that a physician's contradictory testimony doomed a onetime Fosamax user's suit in multidistrict litigation over jaw injuries allegedly caused by the bone drug.

The high court denied a petition for certiorari filed by Linda Secrest, the plaintiff in one of seven bellwethers in the litigation over jaw-related claims.
