Title Insurer's Win In Overcharge Suit Upheld By Fla. Court

Law360, New York (June 5, 2013, 5:16 PM EDT) -- A Florida appeals court refused Wednesday to revive a proposed class action accusing Chicago Title Insurance Co. of overcharging homeowners for title insurance in mortgage refinancing transactions, saying a lower court correctly interpreted Florida law.

The Eleventh Judicial Circuit had granted Chicago Title summary judgment on the basis that Florida law doesn't require the company to search for homeowners' prior insurance policies to see if they may qualify for a lower premium in a refinancing, and the Third District Court of Appeal agreed, saying no reasonable...
