Management Co. Wins Appeal In Subcontractor Injury Case

Law360, Miami (June 5, 2013, 7:30 PM EDT) -- A Florida appeals court Wednesday reversed a lower court's decision in a personal injury case, saying a building management company did not participate in the details of a contractor's work to the extent necessary to make it liable for a worker's injuries.

In reaching its verdict, the trial court applied an exception to a general rule of nonliability for those hiring independent contractors because it concluded that Sterling Financial & Management Inc. had controlled the manner of the work done by Mariusz Gitenis, who suffered injuries...
