Texas High Court Says City Temp's Injury Claim Is Barred

Law360, Dallas (June 10, 2013, 7:37 PM EDT) -- The Texas Supreme Court on Friday said a Houston suburb doesn't have to face a tort claim brought by a temp who lost an arm on the job, saying although he was paid by a staffing agency, he qualified as a city employee covered by its workers' compensation policy.

The court held because the city of Bellaire supervised and indirectly paid Elbert Johnson, his only remedy was to file a workers' compensation claim, reversing an appeals court's decision that said it was unclear whether he qualified...
