7th Circ. Tosses Insurer's Win In Construction Injury Suit

Law360, New York (June 10, 2013, 5:27 PM EDT) -- The Seventh Circuit ruled Friday that an exclusion for injury to contractors was "poorly drafted" and ambiguous, nixing Atlantic Casualty Insurance Co.'s victory in a coverage fight over a tort suit filed by a worker who was struck by a falling beam at a construction site.

In a ruling authored by Judge Richard Posner, the appeals court found that there were two reasonable interpretations of an exclusion for injury to employees, contractors and employees of contractors.
