Del. High Court Tosses Challenge To Beachfront Project

Law360, New York (June 11, 2013, 4:26 PM EDT) -- The Delaware Supreme Court on Monday agreed to toss a suit alleging that a town's settlement agreement with developers of a proposed beachfront hotel, condo and retail complex was invalid because it was a private zoning arrangement, finding the suit is time-barred.

Affirming a Court of Chancery dismissal, the court found that the complaint, lodged by several Town of Dewey Beach residents, had not been filed within a required 60-day period and that the residents had other remedies at their disposal, according to the opinion....
