High Court Raises Bar For Title VII Retaliation Claims

Law360, New York (June 24, 2013, 11:46 AM EDT) -- The U.S. Supreme Court ruled Monday that workers bringing Title VII retaliation claims must show that their employer would not have taken action against them but for an improper motive, siding with a Texas hospital that pushed for a strict standard for proving such claims.

In a 5-4 decision, the high court struck down a Fifth Circuit ruling that upheld part of a jury verdict in favor of Dr. Naiel Nassar, a doctor of Middle Eastern descent who claimed he suffered retaliation from the University of Texas Southwestern Medical Center after complaining about alleged racial harassment.
