FBI Search In DuPont Secrets Case Called Unconstitutional

Law360, Chicago (June 27, 2013, 1:47 PM EDT) -- The owners of USA Performance Technology Inc., who are accused of stealing trade secrets from DuPont Co., asked a California federal judge on Wednesday to throw out evidence obtained in a search of their home, claiming investigators trampled on their Fourth Amendment rights.

The FBI’s warrant to search Walter and Christina Liew’s San Francisco-area residence was invalid because it was “impermissibly overbroad” and the agents lacked probable cause, the husband and wife said in a brief filed with the court.
