Bankrupt Exide Can Keep Battery Recycling Plant Open

Law360, Los Angeles (July 2, 2013, 6:06 PM EDT) -- A California judge on Tuesday blocked a state agency's order to shutter bankrupt Exide Technologies Inc.'s Vernon, Calif., battery recycling plant, ruling Exide is likely to win its challenge to the decision because it has reduced pollution levels at the plant.

In granting Exide's request for a preliminary injunction, Los Angeles County Superior Court Judge Luis A. Lavin ruled that the injunction will stay in place until the state Department of Toxic Substances Control's current proceeding against Exide before an administrative law judge is completed. The...
