Prudential Can't Ditch Disability Benefits Class Action

Law360, New York (July 3, 2013, 5:04 PM EDT) -- A New Jersey federal judge on Tuesday trimmed a benefits denial claim from a proposed class action contending a long-term disability plan administered by Prudential Insurance Co. of America shorted a truck driver on payments, saying the claim was filed too late.

U.S. District Judge Esther Salas said that under a three-year statute of limitations for benefits denial claims filed under the Employee Retirement Income Security Act, a former Saia Motor Freight Line Inc. employee who launched the suit in October should have filed his claim...
