Chinese Co. Can't Duck Faulty Drywall Claims, 5th Circ. Told

Law360, New York (July 3, 2013, 7:36 PM EDT) -- The Fifth Circuit on Tuesday heard arguments that American construction companies can bring claims against Taishan Gypsum Co. Ltd. over faulty drywall it manufactured in China, saying the company nonetheless committed torts in Florida.

Alabama construction outfit The Mitchell Co. Inc. urged the appellate court to affirm last year's ruling by U.S. District Judge Eldon E. Fallons that denied Taishan’s attempt to dismiss four related class actions on jurisdictional grounds, including one tied to drywall installed specifically in Florida.
