Contract Allows For $6.5B Archstone Sale, Lehman Says

Law360, New York (July 9, 2013, 3:33 PM EDT) -- Lehman Brothers Holdings Inc. urged a New York state judge Tuesday to throw out a suit brought by a minority investor objecting to the defunct company’s mammoth $6.5 billion sale of apartment owner Archstone Enterprise LP, arguing it was contractually justified in making the deal.

Appearing for oral arguments in a Manhattan courtroom, a Lehman attorney told New York Supreme Court Justice Marcy S. Friedman that under the limited partnership agreement Lehman has with plaintiff Cambridge Capital Real Estate Investments LLC covering the investment in Archstone,...
