Liberty Capital Hit With Junk Fax TCPA Suit In Calif.

Law360, New York (July 10, 2013, 4:35 PM EDT) -- Small business loan provider Liberty Capital Group Inc. on Wednesday was hit with a proposed class action accusing it of violating the Telephone Consumer Protection Act by sending unsolicited faxes to businesses around the U.S.

The lawsuit, filed in California federal court by heating and cooling system contractor Bedard Controls Inc., seeks up to $1,500 in damages for each fax allegedly sent by Liberty Capital in violation of the TCPA, which, figured for the potentially tens of thousands of class members, is more than $5 million....
