Werner Truckers Win Class Cert. In Break Suit

Law360, New York (July 11, 2013, 2:22 PM EDT) -- A Nebraska federal judge on Wednesday certified a class of more than 41,000 truck drivers in a suit accusing Werner Enterprises Inc. of having unlawful meal and rest break policies, saying the truckers within the proposed class were universally impacted by what the suit described as the company’s "systematic denial of compensation."

Senior District Judge Lyle Strom granted certification to all of the drivers in Werner's Student Driver Program during the four years prior to the August 2012 filing of the suit. Named plaintiffs Philip Petrone,...
