EU Eyes Changes To Antitrust Safe Harbor For Minor Pacts

Law360, New York (July 11, 2013, 10:30 PM EDT) -- The European Commission proposed Thursday updating its so-called de minimis guidelines explaining when smaller agreements among companies are safe from the European Union's ban on anti-competitive business deals, in a bid to bring the guidance in line with a recent court ruling.

The EC has long had an antitrust safe harbor for minor agreements between companies. The current version of the guidelines, from 2001, explain the commission won't consider agreements to appreciably limit competition if they involve competitors whose market shares are less than 10 percent...
