Rovi Asks ITC To Reconsider Ban Bid In Netflix Patent War
Law360, New York (July 16, 2013, 7:44 PM EDT) -- Rovi Corp. on Monday urged the U.S. International Trade Commission to reconsider a judge's decision to deny the company's request for a cease-and-desist order against Netflix Inc. as it continues trying to prove that Netflix infringed its patented parental control and program guide technology.
Rovi said that Administrative Law Judge David P. Shaw recommended that no remedial order should be issued even if Netflix is found to have violated Section 337 of the Tariff Act by selling Rovi's technology for importation, a move that it claims departs from long-standing ITC precedent.
