Grupo Bimbo Can't Stall Snack Packaging Suit

Law360, Los Angeles (July 22, 2013, 4:29 PM EDT) -- A California federal judge on Monday denied Grupo Bimbo SAB de CV's request for a preliminary injunction in its trade dress infringement lawsuit against fellow food maker Snak King Corp., ruling there was no likelihood of consumer confusion between Grupo's Takis corn chip snacks and Snak King's Taco-Litos.

At a hearing, U.S. District Judge Audrey B. Collins said that a reasonable consumer would not confuse the two rolled corn products, stating hers was a call that was “not close.”
