MLB Won't Balk In Fla. Drug Clinic Case

Law360, Miami (July 23, 2013, 6:02 PM EDT) -- Major League Baseball fought back Monday against bids to toss its suit accusing a Florida health clinic of providing performance-enhancing drugs to Alex Rodriguez and other players, arguing that its claim is not preempted by federal labor law.

In a memorandum filed in Florida's Eleventh Judicial Circuit Court, MLB said its claim of tortious interference against Biogenesis of America LLC and others affiliated with the clinic is not preempted by the Labor Management Relations Act and can be adjudicated by a state court.
