Prudential Reps Get 2nd Cert. Try In OT Suit

Law360, New York (July 23, 2013, 4:34 PM EDT) -- Current and former Prudential Financial Inc. and Prudential Insurance Co. of America financial representatives who were denied class certification in an overtime wage suit have a new chance to prove they have enough in common for certification, a New Jersey federal judge ruled Monday.

In January, U.S. District Judge Dennis M. Cavanaugh said the certification effort, which asked for 18 subclasses, including 11 state law classes, undermined commonality requirements for class certifications, but he dialed back his stance after the plaintiffs filed a motion for reconsideration...
