Int'l Paper's Appeal Over Connelly Baker Hire Falls Short

Law360, Houston (July 25, 2013, 8:25 PM EDT) -- A Texas appeals court said Thursday that Harris County’s decision to hire Connelly Baker Wotring LLP on a contingency fee basis to pursue a multibillion-dollar environmental enforcement suit against International Paper Co. and Waste Management Inc. did not violate the latter companies’ constitutional rights.

The First District Court of Appeals ruled that although the law firm stands to make millions from an aggressive pursuit of the case, the companies are not being deprived of their right to a “fair and neutral prosecution” under the Fourteenth Amendment....
