Contractor Can't Get Jury Trial In Minimum Wage Suit

Law360, New York (July 29, 2013, 5:46 PM EDT) -- Circle C Construction LLC will not receive a jury trial in a whistleblower's False Claims Act suit over alleged subcontractor wage violations because it didn't properly request one, a Tennessee federal judge ruled Friday.

In October 2012, the Sixth Circuit affirmed a lower court’s ruling that Circle C was liable under the FCA for failing to pay the required minimum wage for subcontracted electrical work at Fort Campbell, Ky., but sent the case back to the district court to recalculate the $1.6 million in damages.
