Herbalife Urges Judge To Toss 'Pyramid Scheme' Class Action

Law360, Los Angeles (July 29, 2013, 9:35 PM EDT) -- Herbalife International of America Inc. urged a California federal judge Monday to throw out a putative class action alleging the nutritional supplement seller operates an unlawful pyramid scheme, arguing that the former distributor suing the company failed to plead plausible facts supporting fraud allegations.

At a hearing before U.S. District Judge Beverly Reid O'Connell, William S. Ohlemeyer, a lawyer representing Herbalife, argued that the plaintiff “pled himself out of court” because nothing in the complaint alleged that an illegal pyramid scheme took place.
