Law360, New York (July 30, 2013, 8:37 PM EDT) -- A proposal to take control of homes through eminent domain to save underwater homeowners from foreclosure is gaining popularity in cities still struggling to rebound from the housing crisis, but land use attorneys say any cities that try it will likely be swamped by lawsuits on constitutional grounds at the ultimate expense of homeowners.
