6th Circ. Upends P&G Pampers Diaper Rash Class Settlement

Law360, New York (August 2, 2013, 4:27 PM EDT) -- The Sixth Circuit on Friday overturned a settlement between The Procter & Gamble Co. and a class of consumers alleging that some Pampers diapers cause diaper rash and chemical burns, blasting the deal for offering $2.7 million in attorneys' fees but providing no real benefit to class members.

In a 2-1 ruling, the appeals court majority determined that the concessions made by P&G under the deal — including the reinstatement of a refund program and various labeling changes — provided limited value to unnamed class members...
