6th Circ. Junks GM Retirees' ERISA Challenge

Law360, New York (August 7, 2013, 8:00 PM EDT) -- The Sixth Circuit on Tuesday rejected a challenge to a trial court's dismissal of an Employee Retirement Income Security Act suit filed by former General Motor LLC executives over retirement benefits slashed during GM's bankruptcy.

A three-judge panel upheld a lower court's decision to grant GM's motion for dismissal of the suit, which claimed the company didn't properly calculate the benefits the retirees were owed under a so-called top hat plan.
