Duane Reade Assistant Managers Can Proceed As Class

By Richard Vanderford (August 8, 2013, 6:51 PM EDT) -- A New York federal judge said Thursday that Duane Reade Inc. assistant managers can proceed as a class in a suit alleging that the pharmacy chain shortchanged them on overtime pay, despite protests from the company.

U.S. District Judge J. Paul Oetken partially upheld his earlier decision certifying a class of about 750 Duane Reade assistant managers who claim that the New York City pharmacy chain misclassified them as exempt from state overtime.

The assistant managers will remain in a class for liability purposes, but must prove damages individually, Judge Oetken ruled.
