Okla. Judge Refuses To Dismiss State Challenge To ACA

Law360, Los Angeles (August 12, 2013, 8:45 PM EDT) -- An Oklahoma federal judge on Monday refused to dismiss the state's lawsuit challenging the Affordable Care Act, ruling that Oklahoma had standing to challenge a rule under which businesses are fined if they don't provide health insurance to their employees.

District Judge Ronald A. White held that Oklahoma Attorney General Scott Pruitt had provided enough evidence to show that the state could be injured by the new federal health care law's so-called “employer mandate” because the State of Oklahoma employs a considerable number of individuals....
