Fla. Appeals Court Reinstates Challenge To County Land Code

Law360, Miami (August 14, 2013, 5:32 PM EDT) -- A Florida appeals court on Wednesday reversed dismissal of a landfill owner's suit against Pasco County, saying it wants the lower court to consider questions of constitutionality about the county's land development code raised by the plaintiff.

The dispute, over permits needed for plaintiff Angelo's Aggregate Materials Ltd. to be able to build a new landfill, has stirred up complex questions about the constitutionality of the county's land development code ordinance and its impact on state courts' jurisdiction.
