J&J, DePuy Fail To Split Up Consolidated Hip Implant Trial

Law360, New York (August 14, 2013, 7:11 PM EDT) -- A New Jersey state judge on Tuesday rejected a bid by Johnson & Johnson and subsidiary DePuy Orthopaedics Inc. to break up the consolidated trial of two bellwether cases alleging injuries from DePuy's ASR hip implants.

Ruling in centralized, state court litigation over the hip implants, Bergen County Superior Court Judge Brian R. Martinotti said he didn't believe the consolidation of the cases for trial would spell prejudice against the companies or confusion for a jury, pointing to similarities between the suits that range from failure...
