Air Force Breached Fla. County Utility Contracts, CFC Finds

Law360, Miami (August 14, 2013, 7:57 PM EDT) -- The U.S. Court of Federal Claims granted summary judgment Wednesday to Bay County, Fla., in a dispute with the federal government over alleged breach of water and sewer service contracts for Tyndall Air Force Base.

In its ruling, the court found that under definitions of the Federal Acquisition Regulations and Defense Federal Acquisition Regulation Supplement, Bay County is an independent regulatory body and, as such, it is entitled to set rates within the guidelines of the contract without having to negotiate them with the Air Force....
