9th Circ. To Review Calif. DNA Law After High Court Ruling

Law360, New York (August 15, 2013, 8:44 PM EDT) -- The Ninth Circuit’s chief judge said Wednesday that the full court will again hear arguments in a class action challenging a California law that allows police to collect DNA samples from suspected felons without a warrant, in light of the U.S. Supreme Court’s recent ruling on a similar Maryland statute.

In a four-sentence order, Chief Judge Alex Kozinski said that the constitutional challenge to a 2004 amendment to California’s DNA and Forensic Identification Data Base and Data Bank Act would be re-argued before the en banc...
