4th Circ. Backs Rite Aid's Unpaid Leave Policy In OT Suit

Law360, New York (August 19, 2013, 7:39 PM EDT) -- The Fourth Circuit on Friday upheld a Maryland federal court's ruling that Rite Aid Corp.'s policy allowing unpaid leave in full-day increments only did not preclude the company from classifying its pharmacists as exempt from overtime pay.

In an unpublished per curiam order, the Fourth Circuit affirmed the lower court's December 2012 decision to grant summary judgment to the company in a proposed class action accusing it of improperly denying its pharmacists overtime in violation of the Fair Labor Standards Act and Maryland state law....
