Overstock.com Dodges Class Action Over Return Fees

Law360, New York (August 19, 2013, 6:07 PM EDT) -- A New York federal judge on Monday tossed a class action against Overstock.com Inc. alleging the company improperly charged a customer a $30 restocking fee after she returned a vacuum cleaner, finding that the company's return policy would not be misleading to a reasonable consumer. 

Judge Sterling Johnson Jr. dismissed the case, ruling that Cynthia Hines failed to sufficiently demonstrate that Overstock violated consumer protection laws and that the online retailer's alleged failure to explicitly disclose its restocking fee constituted a deceptive act.
