Vail Ski Resort Wipes Out In Trademark Case

Law360, New York (February 11, 2008, 12:00 AM EST) -- Skiers planning a vacation to Vail, Colo., will still be able to call 1-800-SKI-VAIL for information, now that an appeals court has ruled the number does not infringe on a trademark held by the town's largest resort.

Vail Associates Inc., which operates the Vail Ski Resort, holds a trademark on the single word “Vail.” It sued Vend-Tel-Co Ltd. in 2001, alleging that the company's 1-800-SKI-VAIL information line infringed on it mark and would confuse consumers trying to reach the resort.
