Nonpublic Facebook Posts Shielded By SCA, Judge Says

Law360, New York (August 23, 2013, 8:08 PM EDT) -- A New Jersey federal court ruled Tuesday that nonpublic Facebook wall posts are covered by the federal Stored Communications Act, but that a hospital had not improperly accessed such a post in viewing an employee's screenshot of a co-worker's page.

U.S. District Judge William J. Martini granted summary judgment to Monmouth-Ocean Hospital Service Corp., which operates as MONOC, in a lawsuit brought by employee Deborah Ehling, which included an SCA claim stemming from an incident involving her Facebook wall.
