State Farm Beats Auto Policy False Ad Suit In 2nd Circ.

Law360, New York (August 26, 2013, 3:22 PM EDT) -- The Second Circuit on Monday rejected class action claims that State Farm Insurance Co. deceived no-fault car insurance policyholders about the level of coverage afforded, backing a lower court that said the lead plaintiff was prohibited from arguing he had overpaid the insurer.

The suit targeted an option in State Farm’s car insurance policies that extended its Personal Injury Protection coverage to injuries sustained by passengers of vehicles operated by the insured, which plaintiff Dominick Servidio argued was promoted deceptively.
