Wyeth Sues Apotex Over Injectable Protonix ANDA

Law360 (February 12, 2008, 12:00 AM EST) -- Wyeth has filed suit against generics maker Apotex Inc. for allegedly infringing its patent for an injectable version of heartburn treatment Protonix.

The generics producer is jumping the gun by filing an abbreviated new drug application with the U.S. Food and Drug Administration for a generic version of the drug before the patent has expired, Wyeth claims.

Wyeth, which distributes Protonix in the U.S., and German pharmaceutical company Nycomed GmbH, the owner of the patent in suit, filed the complaint Thursday in the U.S. District Court...
